    The Democratic State, inaugurated with the 1988 Constitution, is part of a complex system of principles, values and rules long sought by society. Democracy, the objective pursued in most countries of the world, although a concept known since Ancient Greece, has only attained prominence in modern times with the real participation of the people in key decisions in the country. Therefore, knowing that there is no possibility of offering a ready, finished concept for democracy, certain characters may appear as fundamental to current Brazilian democracy. The principles embodied in the 1988 Constitution realize that popular sovereignty has to be the main vector of the democratic ideal in which is embedded a possible direct participation of the people or common actions through their representatives. The objective of this paper is to confront the National Finance Policy Council with the democratic ideal.

    An awakening to the adjustments promoted by the Council is proposed to legal scholars by assessing their relevance to the model of society that is expected to be built. The importance of examining this theme reappears in a federation so economically and socially uneven, which warrants a review of mechanisms to address inequalities.

    O Estado Democrático de Direito, inaugurado com a Constituição de 1988, faz parte de um complexo sistema de princípios, valores e regras há muito almejados pela sociedade.

    A democracia, objetivo perseguido na maior parte do mundo, apesar de já conhecida desde a Grécia Antiga, apenas com a Modernidade ganha relevos de real participação do povo nas decisões fundamentais do País. Assim, mesmo sabendo-se da impossibilidade de se ofertar conceito pronto e acabado para a democracia, certos caracteres podem ser indicados como fundamentais à atual democracia brasileira. Os princípios espargidos na Constituição Federal de 1988 dão conta de que a soberania popular há de ser o vetor principal do ideal democrático, nele albergada eventual participação direta do povo ou mesmo a comum atuação por meio de seus representantes. O objetivo com este trabalho é confrontar o Conselho Nacional de Política Fazendária com o ideal democrático. Propõe-se despertar, nos estudiosos do Direito, o interesse sobre os ajustes promovidos por esse Conselho, avaliando sua pertinência com o modelo de sociedade que se espera estar sendo construído.. A importância de sua análise ressurge em uma federação tão desnivelada econômica e socialmente, o que faz pensar em mecanismos para evitar tantas desigualdades.
