    Mediante contextualização histórica, procurou-se, neste trabalho, demonstrar a evolução da percepção do fenômeno jurídico, tendo como pano de fundo o papel desempenhado pelo Estado na regulação do fenômeno econômico. Visando facilitar o entendimento dos leitores, houve a preocupação de manter uma linha evolutiva condutora, de modo a retratar as mutações sofridas na atuação estatal, bem como a necessidade de o Estado se adaptar às novas demandas sociais, políticas e econômicas, em busca da legitimidade de seus atos. Nesse contexto, o foco primordial do trabalho é demonstrar a necessidade de o Estado se inserir na nova dinâmica introduzida pelo paradigma do Estado Democrático de Direito por meio de programas de participação popular nos processo decisórios, a fim de que os resultados das políticas regulamentares estatais sejam legitimados por um processo dialógico-discursivo.

    Through a historical context, this study seeks to demonstrate the evolution of the perception of the legal phenomenon, with the role of the state in regulating economic phenomenon as a backdrop. In order to facilitate the readers� understanding, there was a concern to maintain an orienting evolutionary line in order to portray the changing shape of the state action and the need for the state to adapt to new social, political and economic demands in search of legitimacy of its actions. In this context, the primary focus of the study is to demonstrate the need for the state to enter the new dynamic introduced by the paradigm of the Democratic State of Law through programs that involve the participation of all people in the decision-making process, so that the results of state regulatory policies are legitimized by a dialogic-discursive process.
