    In spite of the fact that the Federal Constitution adopts a basis of principles for the different topics it covers throughout its text, there is still a great deal of resistance in the Brazilian legal environment against the normative and binding character of principles. For this reason, whenever possible, it is necessary to establish a legal interpretation that ensures that principles will not function as mere guidelines, but will have a normative function; one that will determine what ought be that is needed to solve and prevent conflicts, in order to permit social peace and the happiness of the largest number of people.

    Apesar de a Constituição da República adotar em todo o seu texto uma base principiológica para os diversos assuntos que disciplina, ainda existe no ambiente jurídico brasileiro uma grande resistência ao reconhecimento do caráter normativo e impositivo dos princípios. Por isso faz-se necessário, sempre que possível, estabelecer uma interpretação jurídica que assegure aos princípios não apenas uma função programática, mas uma função normativa, determinadora do dever-ser necessário à solução e à prevenção de conflitos, de modo a permitir a paz social e a felicidade do maior número possível de pessoas.
