    By providing historical context, this study seeks to demonstrate the evolution of the legal concept of contracts and the implications for the comprehension of this legal phenomenon, in light of a new order of ideas. The theme was divided into two large items to facilitate understanding of the topic for the readers:

    one item was reserved for the study of classic contract theory and the other for modern contract theory. In this context, we see a notable interest in harmonizing the alterations that the legal concept of contract underwent, with the transformations imposed by the succession of State paradigms. The objective of this study was to demonstrate, while always maintaining a leading posture, the significant change observed in the understanding of contractual dynamics, with one of its main beacons being the relation between State actions and private and individual interests.

    Mediante contextualização histórica, procurou-se, neste trabalho, demonstrar a evolução da noção do instituto do contrato e suas implicações para compreensão do fenômeno jurídico, diante de uma nova ordem de idéias. Visando facilitar o entendimento dos leitores, houve a preocupação em subdividir o tema em dois grandes itens: um reservado para o estudo da teoria contratual clássica e o outro, para o estudo da teoria contratual moderna.

    Nesse contexto, observa-se notório interesse em harmonizar as alterações sofridas na concepção do instituto jurídico do contrato, com as transformações impostas pelas sucessões de paradigmas de Estado. Com efeito, neste estudo teve-se por objetivo demonstrar, mantendo sempre uma linha condutora, a significativa mudança observada na compreensão da dinâmica contratual, tendo como uma de suas principais balizas a relação mantida entre a atuação estatal e os interesses privados e individuais.
