    In this article we analysed the possible relations between Democracy and Constitution, as well as between Democracy and Human Rights, inserted in the context of National State, and International Community. Studies of Constitucional Law, International Law and Communitary Law were necessary. The historical e ontological aspects of Democracy, Constitution and Human Rights were considered in order to achieve the conclusion that there is no Constitution without Democracy, neither Human Rights without Democracy.

    Neste artigo, analisamos as relações possíveis entre Democracia e Constituição, bem como entre Democracia e Direitos Humanos, no contexto do Estado Nacional e no da Comunidade Internacional. Estudos de Direito Constitucional, de Direito Internacional e de Direito Comunitário foram necessários. Os aspectos históricos e ontológicos da Democracia, da Constituição e dos Direitos Humanos foram considerados para que chegássemos à conclusão de que não há Constituição sem Democracia, nem há Direitos Humanos sem Democracia.
