    El autor considera a los DESC como derechos fundamentales, existiendo diversos supuestos que apoyan la tesis que les reconoce exigibilidad procesal. La investigación se inicia con un breve recuento contemporáneo sobre el concepto de derecho fundamental, su concepción en el Derecho chileno, las tres posibilidades de invocación del mismo y su delimitación, para luego internarse en tres aspectos específicos sobre los DESC, su naturaleza jurídica, cómo enfrentar las contiendas entre DESC y otros derechos fundamentales; finalmente, enuncia diversos obstáculos que merman o impiden su eficacia.

    The author considers the social and economics rights like fundamental rights, with procedural exigibility. The paper begins with a brief exposition of contemporary concepts of fundamental rights, its conception in the Chilean law, the three possibilities of invocation of same and the their boundary. The study finish with three specific aspects of social rights: their nature, how to FACE the conflicts between fundamental rights and finally, diverse obstacles that affects their effectiveness.
