    En los últimos años se ha venido presentando un fenómeno acelerado de agrupamiento, el cual se ha traducido en la existencia de grandes grupos empresariales con trascendencia internacional. La mayoría de ellos con su sede principal en Estados Unidos, razón por la cual se hace imprescindible y útil el estudio del régimen de los grupos empresariales en Norteamérica, mas aún ahora que estamos ad portas de un TLC con Estados Unidos. El presente articulo pretende analizar los presupuestos de la existencia del grupo empresarial y las diferentes dificultades que pueden presentarse en torno al mismo haciendo una análisis comparativo con la regulación al respecto en los Estados Unidos.

    Nowadays is very common to find that corporate groups or groups of companies are growing constantly in size and number. These groups also have an international perspective and implications. The majority of these groups have their establishments within the United States of America and thus, it is necessary and useful to study the law that rules this kind of institutions in this country, particularly having into account that Colombia is now ready to adopt a free trade agreement with this nation. This article aims to make an analysis of the requirements for the existence of the company group and the different problems that can arise during its operation making a comparative analysis between Colombian and US regulation.
