Los clubes de protección e indemnización (P&I clubs) y su operación a la luz del derecho colombiano

    Los clubes de protección e indemnización son asociaciones de armadores que conforman fondos mutuales sin ánimo de lucro, con el fin de otorgar cobertura a sus miembros en relación con las responsabilidades en que puedan incurrir con ocasión de la actividad marítima que desarrollan. Normalmente estos organismos cubren riesgos relacionados con la pérdida o daños a la carga, muerte o lesión de tripulantes o pasajeros, abordaje, colisión y contaminación marina, entre otros.Este artículo realiza un estudio de sus orígenes, sus principales características, así como su funcionamiento bajo la óptica del ordenamiento jurídico colombiano realizando algunas sugerencias que abogan por un cambio de tratamiento para facilitar su operación en el país.

    The subject of analysis of the article is the reform of the Spanish maritime legislation specially taking into account the First draft of the General Law of Navigation, and the effects the regulation will have in the registry of vessels considering that previous Maritime Spanish Law it is not compiled in a single body of norms, with aspects in the practical operation of this field pertaining to other legislations or regulated in an inadequate manner. The subjects regulated by the First draft was prepared by a special section for the reform of the Law of Navigation and has been structured in attention to the main issues in the matter: the aquatic means in which navigation is made; the vehicle with which navigation is made; the person who organizes the instruments with which the displacement by the water is made, and, the main activity.
