    In this article Seyla Benhabib criticizes Rawls�s theory of international justice in The Law of Peoples. According to Benhabib, Rawls�s theory is based inadequately on the notion of «peoples» and doesn�t take into account the relevance of migratory phenomena for the issue. A part from that, she is critical concerning the attempts carried out by cosmopolitan theorists who want to use Rawls in order to go beyond Rawls himself. According to the author, the right to membership ought to be considered a human right.

    En aquest article Seyla Benhabib critica el plantejament de la justícia internacional que John Rawls va exposar a El dret de gents. Segons Benhabib, la teoria rawlsiana es basa inadequadament en el concepte de «gents» o «pobles» (peoples) i no té en compte la rellevància dels fenòmens migratoris. Així mateix, es mostra crítica amb els intents dels cosmopolites que volen aprofitar Rawls per anar més enllà de Rawls. Segons l�autora, el dret de pertinença hauria de ser considerat un dret humà.
