Federalisme, descentralització i pluralisme nacional: teoría política i anàlisi comparada

    En este artículo se plantea el tema de las democracias plurinacionales y su posible acomodación política a través de modelos federales. El planteamiento analítico es doble. Por un lado, se abordan algunos elementos de la discusión teórica de carácter normativo sobre las democracias liberales en contextos de pluralismo nacional y cultural. Por otro lado, se aborda un análisis comparado de las federaciones y de algunos estados regionales en relación a su carácter uninacional o plurinacional, su grado de federalismo, su grado de descentralización, y la regulación o no de asimetrías legales. El artículo concluye señalando las posibilidades y los límites de los modelos federales en contextos plurinacionales, abogándose por el modelo caracterizado como ¿federalismo plurinacional¿, basado en tres condiciones normativas:

    un reconocimiento constitucional y político explícitos del pluralismo nacional de la federación, un alto grado de autogobierno en cinco ámbitos de aplicación por parte de las minorías nacionales, y el establecimiento de mecanismos de participación y de condiciones, que concretan la regulación institucional de las libertades positivas y negativas colectivas que permitan una acomodación política y constitucional legítima y estable en las democracias plurinacionales.

    This article examines the topic of multi-national democracies and their possible political adaptation via federal models. The analysis has two main centres of focus. First, it discusses some of the elements of the theoretical dialogue on legislation in liberal democracies on such topics as national and cultural pluralism. Secondly, it carries out a comparative analysis of the federations and of some regional states in the context of their uni-national and multi-national character, their degree of federalism, their degree of decentralisation and the regulation of legal asymmetries or lack thereof. The article concludes by pointing out the possibilities and limits of federal models in multinational backdrops, advocating instead the model characterised as ¿multi-national federalism¿ based on three normative conditions: explicit political and constitutional recognition of national pluralism of the federation, a high degree of self-governance in five areas of application on behalf of national minorities, and the establishment of mechanisms for participation and conditions.

    All of these call for the institutional regulation of both the positive and negative collective freedoms that allow legitimate and stable political and constitutional accommodation in the multi-national democracies.
