Resumen de Consideraciones de Gadamer sobre comprensión, interpretación y aplicación:: Kaufmann e interpretación jurídica*

El objetivo es analizar hasta qué punto las consideraciones que ofrece Gadamer sobre comprensión, interpretación y aplicación se relacionan con el planteamiento hermenéutico de Kaufmann respecto a la interpretación del texto jurídico. El enfoque metodológico elegido es comprensivo e interpretativo. Se destacan dos resultados: 1) se mostró de la mano de Gadamer que la integralidad del proceso hermenéutico constituye la condición que hace posible al intérprete realizar el diálogo entre el lenguaje de la norma y la tradición; y 2) se concretó que la forma de entender la comprensión del texto jurídico, según Kaufmann, se basa en el reconocimiento de la historicidad y la capacidad de creación del juez. Se concluye que existe una relación de proximidad conceptual entre el planteamiento hermenéutico de Kaufmann y el punto de vista de Gadamer en lo referido a la interpretación del texto jurídico.

The objective is to analyze to what extent the considerations that Gadamer offers about understanding, interpretation and application are related to Kaufmann's hermeneutic approach regarding the interpretation of the legal text. The chosen methodological approach is comprehensive and interpretative. Two results stand out: 1) it was shown by the hand of Gadamer that the integrality of the hermeneutic process constitutes the condition that makes it possible for the interpreter to carry out the dialogue between the language of the norm and the tradition; and 2) it was established that the way of understanding the understanding of the legal text, according to Kaufmann, is based on the recognition of the historicity and the creative capacity of the judge. It is concluded that there is a relationship of conceptual proximity between Kaufmann's hermeneutic approach and Gadamer's point of view regarding the interpretation of the legal text
