La implantación de la materia denominada genéricamente Educación para la Ciudadanía en el sistema educativo español ha dado lugar a la presentación de más de 52.000 objeciones de conciencia ante la Administración. Cuando se están sustanciando más de 2.000 procedimientos judiciales ante los Tribunales de justicia por este motivo, el Tribunal Supremo se ha pronunciado por primera vez sobre el tema, en cuatro sentencias dictadas por el Pleno de la Sala de lo Contencioso Administrativo el 11 de febrero de 2009. Se trata de sentencias interpretativas que, sin embargo, no han zanjado definitivamente la cuestión, pues el conflicto sometido a la jurisdicción de los magistrados ha quedado realmente sin dirimir. Se analizan en el presente trabajo las sentencias y se ponen en evidencia sus contradicciones y su débil argumentación.

The introduction of the substance generically known as Education for Citizenship in the Spanish educational system has led to the submission of more than 52.000 objection to the Administration. For this reason are 2.000 legal proceedings before the courts, the Supreme Court has spoken for the first time on the subject, in four sentences handed down by the Plenary of the Chamber of Administrative Litigation of the February 11 2009. These are interpretative judgments, however, have not settled the question definitively, because the conflict under the jurisdiction of the judges was not really settle. Discussed in this paper and the sentences reveal its contradictions and its weak argument.
