Abstract This work presents an analysis of comparative law that aims to identify the legal instruments that have been established and applied in other systems in order to overcome remunerative discrimination, in order to subsequently evaluate their incorporation into the Chilean system. To this end, those from the Province of Quebec, Sweden and Spain were selected, the respective instruments were identified and their operation in both the legal and labor relations systems was analyzed. This study made it possible to identify the active measures and remuneration transparency that are established by each company, together with the participation of the workers’ representatives for their implementation. However, this last element has shortcomings in the Chilean system, given the weakness of its union structure, so the incorporation of such measures would pose great challenges.
