La inclusión en la seguridad social del alumnado en prácticas: últimos cambios normativos y nuevos criterios interpretativos

    Antes de la efectiva entrada en vigor de la nueva regulación de la inclusión en el Régimen General de la Seguridad Social del alumnado en prácticas prevista en la DA 52ª TRLGSS, el Real Decreto-Ley 8/2023 ha procedido a introducir diferentes e importantes previsiones que afectan al régimen jurídico de esta materia. Asimismo, ante las innumerables dudas interpretativas que planteaba la efectiva entrada en vigor de dicha disposición normativa, se han planteado innumerables consultas que han sido resueltas por la Dirección General de Ordenación de la Seguridad Social. En este comentario se procede precisamente a exponer de una forma ordenada las diferentes modificaciones introducidas por el Real Decreto-Ley 8/2023 en el régimen jurídico aplicable a la inclusión en la Seguridad Social del alumnado en prácticas, así como los criterios interpretativos elaborados por la Dirección General de Ordenación de la Seguridad Social sobre la aplicación de la DA 52ª TRLGSS.

    Before the effective entry into force of the new regulation of the inclusion in the General Social Security Regime of trainee students provided for in the DA 52nd TRLGSS, Royal Decree-Law 8/2023 has proceeded to introduce different and important provisions that affect the legal regime of this matter. Likewise, given the innumerable interpretative doubts raised by the effective entry into force of said regulatory provision, innumerable queries have been raised that have been resolved by the General Directorate of Social Security Regulation. In this comment, we proceed precisely to explain in an orderly manner the different modifications introduced by Royal Decree-Law 8/2023 in the legal regime applicable to the contribution of students in internships, as well as the interpretative criteria developed by the General Directorate of Planning of Social Security on the application of DA 52nd TRLGSS.
