El TJUE ha respondido en dos recursos prejudiciales, presentados ambos por tribunales españoles, a varias cuestiones sobre la interpretación de las normas de Derecho internacional privado europeo en materia de contratos de consumo, tanto respecto de los foros protectores previstos en la Sección IV del RBIbis como de la norma de conflicto materialmente orientada contenida en el art. 6 RIR. Las respuestas no sorprenden en absoluto ya que se ajustan a los Reglamentos y a la evolución jurisprudencial de los preceptos en cuestión. No obstante, quizás las preguntas no estuvieron del todo bien planteadas o mejor dicho no se preguntó todo lo que hubiera sido deseable que se clarificara. De ahí que este trabajo analice también cuestiones que han quedado en el tintero como la posibilidad de utilizar el foro de la sucursal por parte de consumidores no europeos para atraer a empresas no europeos a tribunales europeos o la posible imperatividad internacional del Derecho español
The CJEU has answered in two preliminary rulings, both submitted by Spanish courts, to several questions on the interpretation of the European private international law rules on consumer contracts, both with regard to the protective jurisdiction rules provided for in Section IV of the BIbisR and the conflict rule contained in Art. 6 RIR. The answers are not at all surprising as they are in line with the Regulations and the CJUE case law. However, perhaps the questions were not entirely well posed, or rather not all the questions that it would have been desirable to clarify were asked. Hence, this paper also analyzes issues that have been left unanswered, such as the possibility of using the jurisdiction over establishments by non‐ European consumers to attract non‐European companies to European courts or the possibility to characterize Spanish law as an overring mandatory provision.
