    La presente reflexión aborda, con atenta mirada sobre los pronunciamientos judiciales existentes en la materia, alguna de las cuestiones más trascendentes y de más compleja interpretación de la normativa de las elecciones a representantes unitarios. La relevancia de la mesa electoral y las clases de ésta, así como las divergencias normativas en atención a la naturaleza de la prestación de servicios, administrativa o laboral; la obligatoria remisión del censo laboral y sus destinatarios; las dificultades propias de la confección del censo electoral, nacidas de circunstancias subjetivas o de vicisitudes de la relación laboral; o los consabidos problemas de determinación del número de representantes a elegir, resultantes de la dificultad de precisar la fecha a considerar y la inclusión en el cómputo de las jornadas de trabajo realizadas en el período anual previo al preaviso también por los trabajadores con contrato extinguido, son algunas de estas cuestiones.

    The present reflection addresses, with a careful look at the existing judicial pronouncements on the subject, some of the most transcendental and most complex interpretation of the regulations governing elections of workers" unitary representatives. The relevance of the polling station and the types of polling stations, as well as the regulatory divergences according to the nature of the provision of services, administrative or labour; the obligatory submission of the workers of the electoral unit list and its recipients; the difficulties inherent in the drawing up of the electoral roll, arising from subjective circumstances or the vicissitudes of the employment relationship; or the well-known problems in determining the number of representatives to be elected, resulting from the difficulty of specifying the date to be considered and the inclusion in the calculation of the working days worked in the annual period prior to the notice period also by workers with a terminated contract, are some of these issues.
