La reforma laboral de 2021 no ha supuesto un cambio radical del Modelo Legal preexistente, sino, una “corrección” significativa de su carácter autoritario (y excesivamente heterónomo) y de su lógica de racionalización pro empresarial. Las sucesivas reformas laborales anteriores a la de 2021 han ido en la línea de una flexibilización negativa de la negociación colectiva y de “limitación” de la fuerza vinculante de los convenios sectoriales (por ejemplo, descuelgues a través, ciertamente, de los Acuerdos colectivos de empresa en sus distintas tipologías; inaplicaciones preferentes por convenio de empresa sin necesidad de alegación de causas justificativa; modificación unilateral de convenios colectivos “extraestatutarios” y Acuerdos Colectivos de Empresa; reclamo sistemático de los arbitrajes obligatorios en última instancia; etcétera). La última reforma de 2021 -en aquellas materias de las que se ocupó- supone un giro encaminado a devolver a la autonomía colectiva las facultades de autogobierno colectivo

The labor reform of 2021 has not entailed a radical change in the pre-existing Legal Model, but rather a significant “correction” of its authoritarian (and excessively heteronomous) character and its pro-business rationalization logic. The successive labor reforms prior to that of 2021 have been along the lines of a negative flexibilization of collective bargaining and “limitation” of the binding force of sectoral agreements (e.g., opt-outs through, certainly, the different types of company collective bargaining agreements; preferential non-applications by company agreements without the need to allege justifying causes; unilateral modification of “extra-statutory” collective bargaining agreements and company collective agreements; systematic call for mandatory arbitration in the last instance; and so on). The latest reform of 2021 -in those matters it dealt with- represents a shift towards returning to collective autonomy the powers of collective self-government.
