La Constitución española contempla a la familia y al matrimonio en los artículos 39 y 32, como bienes constitucionales distintos y bajo su protección. Nuestra Constitución no se decantó por un modelo de familia y la jurisprudencia del Tribunal Constitucional no la define. No obstante, considera que el art. 39 CE ampara tanto a las familias cuya raíz está en el matrimonio, como a las que no tienen ese origen. En el presente trabajo se estudian estas instituciones, y se reflexiona sobre las últimas leyes que han incidido en las mismas, con una especial referencia a la Ley 4/2023, de 28 de febrero, para la igualdad real y efectiva de las personas trans y para la garantía de los derechos de las personas LGTBI.

The Spanish Constitution considers the family and marriage in articles 39 and 32, as different constitutional values under its protection. Our Constitution did not opt for a family model and the jurisprudence of the Constitutional Court does not define it. However, consider that art. 39 CE protects both families whose roots are in marriage and those that do not have that origin. In this work, these institutions are studied, and we reflect on the latest laws that have had an impact on them, with special reference to Law 4/2023, of February 28, for the real and effective equality of trans people and to guarantee the rights of LGTBI people.
