Resumen de El aseguramiento de la responsabilidad civil de terceros en el proceso penal

El Título X del Libro II de la Ley de Enjuiciamiento Criminal (LECrim), se titula «De la responsabilidad civil de terceras personas». En él se regula la forma en que terceros ajenos a la comisión del ilícito penal, responderán por los daños causados como consecuencia de éste. Lo que se regula es la adopción de las medidas a que se refieren los artículos 615 y siguientes de la LECrim, así como la promoción de un posible incidente sobre la procedencia de la apuntada responsabilidad, todo ello en el seno de una pieza separada que se formará al efecto. El tercero adquirirá, por tanto, la condición de responsable civil, cuando se adopte contra él alguna medida de aseguramiento de la responsabilidad, permitiéndosele intervenir tanto durante la investigación, en la pieza separada que se forme, como en el juicio oral, calificando por escrito los hechos.

Title X of Book II of the Criminal Procedure Law, is entitled «On the civil liability of third parties». It regulates the way in which third parties unrelated to the commission of the criminal offence, will respond for the damages caused because of this. What is regulated is the adoption of the measures referred to in articles 615 and following of the Criminal Procedure Law, as well as the promotion of a possible incident on the origin of the indicated responsibility, all within a separate piece that is will form for this purpose. The third party will acquire, therefore, the status of civil liability, when some measure of assurance of responsibility is adopted against him, allowing him to intervene both during the investigation, in the separate piece that is formed, and in the oral trial, qualifying the facts in writing.
