Resumen de Las modificaciones en materia de derecho de familia por la Ley 17/2021 sobre el régimen jurídico de los animales

La Ley 17/2021, de 15 de diciembre, de modificación del Código Civil, la Ley Hipotecaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales, tiene como objeto transformar la condición jurídica de los animales de cosas a seres vivos dotados de sensibilidad. Esta Ley lleva a cabo, entre otras materias, reformas en derecho de familia para dar respuesta a los conflictos que se suscitan en las crisis de pareja para decidir con quien convivirá el animal de compañía y si podrá acordarse la tenencia compartida por los miembros de la pareja; la forma en que se realizará dicha tenencia y el reparto de las cargas por el cuidado del animal.

Law 17/2021, of December 15, amending the Civil Code, the Mortgage Law, and the Act of Civil Procedure, on the Legal Regime Animals, aims to transform the legal status of animals from things to sentient beings. This Act carries out, among other areas, reforms in family law in order to for respond to conflicts that arise in civil partnership crisis so that decisions can be taken about with whom the pet animal will live, and about if and how shared ownership by the members of the couple can be ordered; as well as on the way in which they be carried out and the distribution of responsibilities for the care of the animal.
