Objeto y fines de la Agencia Espacial Española: alcance normativo

    Este análisis del objeto y fines generales y específicos de la nueva Agencia Espacial Española (AEE) incide en la importancia de conocer la regulación vigente en España, nacional, comunitaria e internacional, a fin de propiciar su mejor cumplimiento y despliegue de las competencias en materia espacial.

    El interés del presente análisis reside en ofrecer una visión pormenorizada de la regulación española vigente en relación con el objeto y fines generales y específicos de la AEE, desde la visión práctica del ejercicio de la Abogacía, y en aras del asesoramiento jurídico y la defensa de los intereses legítimos de diversos actores de la industria espacial en y desde España.

    El alcance normativo analizado en este trabajo podría contribuir a que la AEE pueda dar un mayor impulso legislativo en el ámbito de sus competencias, para partir de la regulación existente en otros ámbitos con incidencia espacial, y para definir, armonizar y desarrollar una normativa espacial en España que recoja los aspectos administrativos, sustantivos y procedimentales que precisa la actividad y la industria espacial en la actualidad.

    La finalidad de este análisis normativo, sistematizado a partir del objeto de la AEE y de sus fines generales y específicos, es identificar la normativa existente en el momento de creación de la AEE, para delimitar así el actual marco normativo del ordenamiento vigente con impacto directo en el ámbito espacial y ofrecer un punto de partida al Legislador y a los responsables de la AEE, así como a los interesados en el sector espacial. Su fin concreto es abordar ulteriores desarrollos de la legislación española en la materia de actividades espaciales, administración pública espacial y desempeño de sus competencias en espacio ultraterrestre, segmento terreno y en la variedad de aplicaciones y servicios espaciales.

    This analysis of the general and specific aims and objectives of the new Spanish Space Agency (ESA) stresses the importance of knowing the current national, EU and international regulations in force in Spain, in order to promote better compliance and the deployment of competences in space matters.

    The interest of this analysis lies in offering a detailed overview of the Spanish regulations in force in relation to the general and specific aims and objectives of the ESA, from the practical perspective of the practice of law, and for the purpose of providing legal advice and defending the legitimate interests of various actors in the space industry in and from Spain.

    The regulatory scope analysed in this work could help the ESA to give greater legislative impetus within the scope of its competences, to build on existing regulations in other areas with an impact on space, and to define, harmonise and develop a space regulation in Spain that includes the administrative, substantive and procedural aspects currently required by the space activity and industry.

    The purpose of this regulatory analysis, systematised on the basis of the ESA’s purpose and its general and specific aims, is to identify the regulations existing at the time of the creation of the ESA, in order to define the current regulatory framework of the current legislation with a direct impact on the space sector and to provide a starting point for the legislator and those responsible for the ESA, as well as for those interested in the space sector. Its specific purpose is to address further developments of Spanish legislation in the field of space activities, space public administration and the performance of its competences in outer space, ground segment and in the variety of space applications and services.
