En los últimos dos siglos en Perú se han promulgado trece constituciones, pero la lealtad de los gobernantes ha sido inconsistente. Estas cartas políticas se ajustaron a las necesidades, incluyendo cambios estructurales y coyunturales debidos a guerras y revoluciones. En el siglo xxi, la tendencia continúa con una crisis política desencadenada por el Congreso por la tercera solicitud de destitución del presidente Pedro Castillo en diciembre de 2022. Hubo un intento de autogolpe fallido, resultando en la destitución de Castillo y la designación de la vicepresidenta Dina Boluarte como su reemplazo. Las protestas y marchas a nivel nacional exigen elecciones generales y una asamblea constituyente. La crisis ha revelado la conciencia constitucional de la ciudadanía, pero también ha llevado a la represión y muerte de personas, principalmente indígenas. En este contexto, se analizan las causas constitucionales de la crisis, el papel del Tribunal Constitucional y las perspectivas de solución a través de la reforma constitucional.

In the last two centuries in Peru, thirteen constitutions have been enacted, but the loyalty of the rulers has been inconsistent. These political charters were adjusted to the needs, including structural and conjunctural changes due to wars and revolutions. In the 21st century, the trend continues with a political crisis triggered by the third call of Congress for the impeachment of President Pedro Castillo in December 2022. There was a failed self-coup attempt, resulting in Castillo’s ouster and the appointment of Vice President Dina Boluarte as his replacement. Nationwide protests and marches demand general elections and a constituent assembly. The crisis has revealed the constitutional conscience of the citizenry, but has also led to the repression and death of people, mainly indigenous. In this context, the constitutional causes of the crisis, the role of the Constitutional Court and the prospects for a solution through constitutional reform are analyzed.
