Resumen de La legítima defensa de la mujer frente a la violencia habitual en su relación de pareja o expareja con un hombre

El objetivo que tiene esta investigación es analizar la aplicación de la causa de justificación de legítima defensa en aquellas situaciones en las que una mujer se defiende frente al ejercicio habitual de la violencia física o psíquica infligida por su pareja o expareja hombre tipificada como delito en el artículo 173.2º del Código penal. Para ello se estudia, en primer lugar, el contenido de injusto de este delito con el fin de aportar las claves para valorar la respuesta defensiva de la mujer que se resiste o reacciona frente a dicha violencia habitual. En segundo lugar, con las conclusiones obtenidas se procederá, en su caso, a interpretar más adecuadamente y sin estereotipos aquellos requisitos de la causa de justificación de legítima defensa que se muestran controvertidos en estas situaciones.

The aim of this research is to analyze the application of the justification of legitimate defense in situations in which a woman defends herself against the habitual exercise of physical or psychological violence inflicted by her male partner or ex-partner, as defined as an offense in article 173.2 of the Criminal Code. To this end, firstly, the unjust content of this offense is studied in order to provide the keys to assess the defensive response of the woman who resists or reacts to this habitual violence. Secondly, the conclusions obtained will be used, where appropriate, to interpret more adequately and without stereotypes those requirements of the justification of legitimate defense that are controversial in these situations.
