México como nación pluricultural. Una propuesta de articulación sociojurídica en el siglo XXI

    Esta investigación plantea como supuesto cardinal la pertinencia de articular un sistema jurídico integral en materia de derechos indígenas que permita la convivencia armónica de instituciones y normas del derecho positivo mexicano y de los sistemas jurídicos de los pueblos indígenas originarios que habitan en el territorio nacional. Se trata de un estudio sociojurídico complejo que busca facilitar el tránsito de la etapa de hegemonía jurídica monocultural ejercida en este ámbito por el poder del Estado-nación, hacia una etapa de pluralismo jurídico multicultural. El análisis abarca los niveles internacional, federal, estatal, municipal y comunitario. La hipótesis se finca en la orientación del reconocimiento de México como nación multiétnica y pluricultural, y en la importancia que poseen los derechos consagrados en favor de dichos grupos humanos gracias a la reforma de los artículos 1o. y 2o. constitucionales de 2001.

    This essay takes as its fundamental premise the relevance of integrating a judicial system for indigenous rights that will enable the institutions and norms of Mexican positive law to coexist in harmony with the judicial systems of the original indigenous peoples inhabiting Mexican national territory. This is a complex socio-judicial study that seeks to facilitate the transition from the stage of monocultural judicial hegemony as exercised by the power of the nation-state, to a stage of multicultural judicial pluralism. The analysis encompasses the international, federal, state, municipal and community levels. The hypothesisis guided by the recognition of Mexico as a multiethnic and pluricultural nation, and by the importance given to the rights of these human groups in the reform of articles 1 and 2 of the Mexican Constitution in 2001.
