    El presente trabajo tiene por objeto el estudio del bien jurídico de los delitos contra la Seguridad Social (artículos 307, 307 bis y 307 ter del Código Penal), que ha aparecido en el moderno Estado social y democrático de Derecho como un bien jurídico autónomo y con un carácter típicamente social. En efecto, a partir del artículo 41 de nuestra Constitución Española, se puede sostener con rotundidad que la Seguridad Social ha surgido como un bien jurídico de carácter constitucional; y, como bien jurídico, es merecedora de una protección típicamente penal, al ser insuficiente la protección otorgada a la Seguridad Social desde otras ramas del ordenamiento jurídico. Por ello, el legislador penal ha reaccionado aprobado distintas leyes orgánicas que han modificado el Código Peal han introducido una serie de delitos específicos contra la Seguridad Social, o añadiendo modificaciones a los delitos ya existentes.

    The purpose of this paper is to study the legal good of crimes against Social Security (articles 307, 307 bis and 307 ter of the Criminal Code), which has appeared in the modern social and democratic State of Law as an autonomous legal good with a typically social character. In fact, based on Article 41 of our Spanish Constitution, it can be categorically stated that Social Security has emerged as a legal asset of a constitutional nature; and, as a legal asset, it is deserving of a typically criminal protection, since the protection granted to Social Security from other branches of the legal system is insufficient. For this reason, the criminal legislator has reacted by passing various organic laws that have modified the Penal Code, introducing a series of specific offenses against Social Security, or adding modifications to existing offenses.
