A Comissão Interamericana de Direitos Humanos e a pandemia de COVID19: análise de relatórios temáticos à luz da Resolução 1/2020

    Within the movement of international protection of human rights, regional protection systems emerged, among them the Inter-American System, initiated in 1969. The Inter-American System acts through the Inter-American Commission of Human Rights and the Inter-American Court of Human Rights. This article aimed at synthesizing the discussing the human rights focus given by the Inter-American Commission to the thematic reports published after COVID19 pandemics, in the light of Resolution 1/2020 on the Pandemics and Human Rights. This is a descriptive research, based on documental analysis of the thematic reports available at the Inter-American Commission site (http://www.oas.org/pt/cidh/), which were approved after January 2020, when COVID19 was declared a public health emergency of international importance until June 2021, when data were collected. Seven reports were initially collected and four were part of the final sample. Authors analyzed 85 recommendations of Resolution 1/2020 and 4 thematic reports with focus on specific groups of the population: LGBTI, persons deprived of liberty, refugees and stateless persons and human rights defenders. Results showed the emphasis of the Commission on the right to health of these groups, as well as the specificities which characterize the violation of their rights, transformed in particular recommendations of state actions and policies.

    No contexto do movimento de proteção internacional dos direitos humanos, foram conformados sistemas protetivos regionais, dentre eles o Sistema Interamericano, iniciado a partir de 1969. O Sistema Interamericano atua por meio da Comissão Interamericana de Direitos Humanos e a Corte Interamericana de Direitos Humanos. Este artigo apresentou como objetivos sintetizar e discutir o enfoque de proteção aos direitos humanos atribuído pela Comissão Interamericana de Direitos Humanos (CIDH) em seus relatórios temáticos publicados após a pandemia de COVID19 e à luz da Resolução I sobre Pandemia e Direitos Humanos. Trata-se de pesquisa documental e descritiva, realizada a partir da análise dos relatórios temáticos disponíveis no site da Comissão Interamericana de Direitos Humanos (http://www.oas.org/pt/cidh/) e que foram aprovados após janeiro de 2020, quando a COVID19 foi declarada uma emergência de saúde pública de importância internacional até junho de 2021, quando foi realizada a coleta dos dados. Foram lidos na íntegra sete relatórios e selecionados para amostra final quatro relatórios. Dessa forma, foram analisadas 85 recomendações da Resolução 1/2020 e quatro relatórios temáticos com foco em grupos específicos da população: pessoas LGBTI, pessoas em situação de privação de liberdade, pessoas refugiadas e apátridas e defensores de direitos humanos. Os resultados demonstraram a ênfase atribuída pela CIDH ao direito à saúde desses grupos, assim como às particularidades que caracterizam as violações de seus direitos, transformadas em recomendações específicas de ações e políticas estatais.
