    Esse artigo analisa a relação entre a mitigação do princípio da livre iniciativa e as consequências diretas obtidas pela perspectiva da teoria de Schumpeter, assim, o objetivo geral é identificar quais as consequências imediatas sofridas pelo mercado, com intervenção do Estado, frente às inovações disruptivas. Para tanto, é necessário apresentar a teoria de Joseph A. Schumpeter; definir a teoria das inovações disruptivas; analisar da relação entre a mitigação do princípio da livre iniciativa e as inovações disruptivas frente a teoria de Schumpeter. Trata-se de uma pesquisa de método hipotético-dedutivo com viés jurídico propositivo, uma base descritiva e uma abordagem qualitativa, seguindo-se de procedimentos bibliográficos e documentais. Verifica-se que o princípio da livre iniciativa não é absoluto, impondo a constatação de que frente a uma mitigação, a visão de Schumpeter não se desvirtua em relação ao princípio, ao contrário enaltece sua força.

    This article analyzes the relationship between the mitigation of the principle of free enterprise and the direct consequences obtained from the perspective of Schumpeter's theory, thus, the general objective is to identify the immediate consequences suffered by the market, with State intervention, against disruptive innovations. Therefore, it is necessary to present the theory of Joseph A. Schumpeter; define the theory of disruptive innovations; analyze the relationship between the mitigation of the principle of free enterprise and disruptive innovations in view of Schumpeter's theory. This is a research using a hypothetical-deductive method with a propositional legal bias, a descriptive basis and a qualitative approach, followed by bibliographic and documentary procedures. It appears that the principle of free enterprise is not absolute, imposing the observation that, faced with mitigation, Schumpeter's vision does not deviate from the principle, on the contrary, it extols its strength.
