Es objeto de estudio en este trabajo la doctrina de la DGRN/DGSJFP relativa a la renuncia de algún descendiente legitimario, instituido heredero o legatario, al que el causante ha sustituido vulgarmente en el testamento por sus propios descendientes, con especial atención a la resolución de 18 de enero de 2022. Particularmente se analiza si la sustitución debe aplicarse o no cuando el causante ha asignado el legitimario renunciante su legítima estricta y cuál es el papel que desempeña en tal sentido la interpretación de la voluntad del testador.

This paper studies the doctrine of the DGRN/DGSJFP regarding the renunciation of any descendant forced heir, instituted as heir or legatee, whom the testator has vulgarly substituted in the will by his own descendants, with special attention to the decision of January 18, 2022. In particular, it analyses whether or not the substitution should be applied when the testator has assigned the renouning forced heir his strict forced share of the inheritance and what role the interpretation of the testator's will plays in this respect.
