La garantía del ne bis in ídem procesal y la cosa juzgada se encuentran recogidas expresamente en el Código Procesal Penal chileno. El gran número de puntos en común entre ambos institutos ha facilitado una cierta imagen de equiparación por la parte de la doctrina y jurisprudencia. En este trabajo daré argumentos para sostener una diferenciación entre el ne bis in ídem procesal y la cosa juzgada en materia penal. Esta exploración se hará examinando el fundamento y estructura de ambos institutos. Esta distinción generará consecuencias procesales que serán tratadas y que revelarán el valor de la distinción.

Procedural ne bis in idem and res judicata are expressly recognized in the Chilean Procedural Code. The large number common issues between both institutes has facilitated a certain image of sameness by doctrine and jurisprudence. In this paper I will give arguments to support a differentiation between the procedural ne bis in idem and res judicata in criminal matters. This exploration will be done by examining the foundation and structure of both institutes. This distinction will generate procedural consequences that will be treated and that will reveal the value of the distinction.
