La Unión Bancaria ha sido uno de los principales y más recientes avances en el proceso de integración europea. Un proceso acelerado por la crisis económica que sufrió de manera muy acuciante la Unión y que culminó, entre otros, en elReglamento (UE) nº806/2014, de resolución de entidades de crédito que fuesen insolventes o estuviesen en riesgo de serlo. Por su naturaleza, el procedimiento previsto en este texto europeo limita determinados derechos fundamentales, entre los que se encuentra el derecho a ser oído del artículo 41(2) de la Carta de Derechos Fundamentales de la Unión Europea. En este contexto, el presente trabajo aborda la concurrencia o no de dicho derecho, quién sería, en su caso, su titular, así como la limitación de tal garantía en el marco del procedimiento de resolución de entidades de crédito con carácter previo a la toma de decisión.
The Banking Union has been one of the main and most recent steps forward in the process of European integration. This process has been accelerated by the economic crisis that the EU suffered severely and culminated, among other things, in the adoption of Regulation (EU) nº806/2014, of resolution of credit ins-titutions failing or likely to fail. By its very nature, the procedure foreseen by this European norm limits certain fundamental rights, among which the right to be heard guaranteed by article 41(2) of the Charter of Fundamental Rights of the European Union. In this context, the aim of this paper is to tackle the potential existence of this right, its holder and its eventual limitation in the framework of a resolution of a credit institution before the adoption of the decision.
