    El Proyecto de Ley de medidas de eficiencia procesal del servicio público de Justicia acoge las finalidades y medidas del plan de choque del CGPJ del año 2020, y modifica el art. 438 LEC, dando nueva redacción al apartado 4, e introduce los nuevos apartados 5 a 10. A ello se suma el art. 438 bis PLMEP, en el que se agrupan las causas de oposición del vigente art. 444 LEC y el procedimiento testigo del art. 438 PLMEP. En este trabajo se analiza el juicio verbal del nuevo art. 438, que pasa a ser esencialmente escrito en la línea marcada por la reforma del año 2015 y el procedimiento testigo, en ambos casos bajo el prisma de la práctica y, del que resulta notables defectos técnicos que obligarán a un esfuerzo interpretativo que, tratándose de normas procesales, no resulta nada aconsejable.

    The Draft Bill on procedural efficiency measures of the public justice service includes the objectives and measures of the General Council of the Judiciary’s shock plan for the year 2020, and amends article 438 of the Law on Civil Procedure, rewording section 4 and introducing the new sections 5 to 10. To this is added article 438 bis of the Draft Law on Procedural Efficiency Measures (PLMEP), grouping together the causes of opposition of the current article 444 of the Law on Civil Procedure, and the witness procedure of article 438 of the PLMEP. This article analyses the oral proceedings of the new article 438, which essentially become written in line with the 2015 reform, and the witness procedure, in both cases from the standpoint of practice and from which emerge notable technical defects that will require an interpretive effort that, in the case of procedural rules, is not at all advisable.
