    El objeto de este estudio es demostrar que el grado de participación de las personas socias y los órganos para encauzar dicha participación en las sociedades cooperativas justifican un régimen autónomo y suficiente para determinar las condiciones de trabajo de las personas socias trabajadoras y socias de trabajo. A tal efecto se analizará, como ejemplo, la nueva Ley de Cooperativas de Euskadi. Para ello, en primer lugar, se definirá, en general, el alcance del término «participación» en la cooperativa. En segundo lugar, se tomará en consideración, por su relevancia, la extensión del derecho de libertad sindical que recientemente ha realizado el Tribunal Supremo (TS) a las cooperativas. En último término, se trata de analizar la justificación de esta extensión al ámbito cooperativo y valorar su adecuación a la naturaleza societaria que presenta el vínculo entre la cooperativa y las personas socias. En tercer lugar, se analizarán las distintas formas y los distintos ámbitos de participación con los que cuentan o pueden contar las personas socias, lo que servirá para demostrar que las cooperativas presentan alternativas al modelo estrictamente laboral o sindical en lo que se refiere a la regulación del régimen de trabajo.

    The aim of this study is to demonstrate that the degree of participation of the members and the bodies to channel said participation in cooperative societies justify an autonomous and sufficient regime to determine the working conditions of the worker members and work members. To this end, the new Law of Cooperatives of Euskadi will be analysed, as an example. First, the scope of the term «participation» in the cooperative will be defined in general. Secondly, due to its relevance, the extension of the right to freedom of association that the Hight Court has recently made to cooperatives will be taken into consideration. Finally, it is about analyzing the justification for this extension to the cooperative field and assessing its adequacy to the corporate nature that the link between the cooperative and its members presents. Thirdly, the different forms and areas of participation that members have or can have will be analysed, which will serve to demonstrate that cooperatives present alternatives to the strictly labour or trade union model in terms of regulation of the work.
