En este trabajo se analiza la STS Sala 1ª, núm. 799/2022 de 22 de noviembre. En esta sentencia se estudia el concepto de mala fe del art. 19 LCS, y cómo influye en la cobertura del siniestro, si afecta al tercero perjudicado, y cuándo se puede decir que la compañía de seguros no responde ante el perjudicado.

This articles analyses judgment no. 799/2022, of 22 November, handed down by Chamber no. 1 of the Spanish Supreme Court. The ruling covers the concept of bad faith in article 19 of the Insurance Contract Act and how it influences the coverage of the claim, whether it affects the injured third party and when it can be argued that the insurance company is not responsible to the injured party.
