Resumen de De territorios vacíos y fisuras legales: Reflexiones sociojurídicas sobre la intervención territorial en México

  : El ensayo aborda reflexiones socio-jurídicas sobre la intervención territorial. Tiene como objetivo analizar la legislación mexicana que fundamenta la gestión del territorio y de los bienes naturales. Dicho análisis se entreteje y discute con la perspectiva oficial sobre los territorios vacíos, la construcción de fisuras legales y el discurso que le atribuye intencionalmente una vocación con el fin de intervenirlo y modificarlo. Se observa que el enfoque gubernamental sobre los territorios vacíos, bajo el que se desarrollan estudios de planificación territorial y ordenamiento ecológico, generalmente no considera que el territorio está sujeto a procesos culturales, sociales, económicos y políticos múltiples y complejos.

  Se documenta que los grupos de poder aprovechan la laxitud de las disposiciones ambientales y las coyunturas políticas para colocar proyectos altamente transformadores del territorio. Se concluye que esas intervenciones territoriales, lejos de poner en un primer plano la identidad de los que lo habitan y de articular los lazos comunitarios, los erosionan y generan niveles de tensión y conflictividad.

  The essay addresses socio-legal reflections about territorial intervention. Its objective is to analyze the Mexican legislation on which the management of the territory and natural goods is based. This analysis is interwoven and discussed with the official perspective on the empty territories, the construction of legal fissures and the discourse that intentionally attributes to it a vocation in order to enable its intervention and to modify it. It is observed that the governmental focus on empty territories, under which studies of territorial planning and ecological planning are carried out, generally does not consider that the territory is subject to multiple and complex cultural, social, economic and political processes.

  It is documented that the power groups take advantage of the laxity of the environmental provisions and the political junctures to place highly transformative projects of the territory. It is concluded that these territorial interventions, far from putting the identity of the inhabitants in the forefront to articulate community bonds, erodes them and generates levels of tension and conflict.
