Resumen de Capítulo XX. Los “matrimonios por conveniencia” en España y su práctica jurisprudencial

Con los “matrimonios por conveniencia” se persigue ciertos efectos secundarios, accesorios o indirectos del matrimonio, prescindiendo del efecto central o esencial del mismo, que no es otro que la convivencia matrimonial. Existe una contradicción entre la voluntad real, encubierta y la voluntad aparentemente manifestada de los contrayentes y siendo la característica principal la simulación del consentimiento de una o de ambas partes. Los “matrimonio por conveniencia” permiten salvar las normas que regulan los plazos y procedimientos generales, para beneficiar a una de las partes y obtener una autorización de residencia y, posteriormente, la nacionalidad española, siendo una forma clara de fraude al Derecho de la Extranjería y de la Nacionalidad. Al respecto se ha pronunciado, en España, en reiteradas ocasiones, el Tribunal Supremo y la Audiencia Nacional, fijando sus elementos constitutivos, los indicios de la existencia de un “matrimonio por conveniencia” y sus consecuencias, jurídicas.

With “marriages of convenience”, certain secondary, accessory or indirect effects of the marriage are pursued, disregarding the central or essential effect of the marriage, which is none other than marital cohabitation. There is a contradiction between the real, concealed will and the apparently manifested will of the contracting parties, the main characteristic being the simulation of the consent of one or both parties. “Marriages of convenience” make it possible to circumvent the rules that regulate the deadlines and general procedures in order to benefit one of the parties and obtain a residence permit and, subsequently, Spanish nationality, being a clear form of fraud against the Law on Foreigners and Nationality. In Spain, the Supreme Court and the National High Court have ruled on this issue on several occasions, establishing its constituent elements, the indications of the existence of a “marriage of convenience” and its legal consequences.
