Los menores de edad, sobre la base de su inmadurez, tienen limitada la capacidad jurídica y su capacidad de obrar. Del mismo modo, en el ámbito del Derecho penal, tienen también limitada su capacidad para responsabilizarse por los delitos cometidos. Sin embargo, esto no impide que el legislador pueda establecer, cuando así se considere conveniente, un límite de edad distinto para el ejercicio de determinados derechos y obligaciones en función de su edad y su grado de madurez. Si bien se reconoce la titularidad de derechos a todas las personas menores de 18 años (capacidad jurídica), el ejercicio efectivo de esos derechos depende del grado de desarrollo y de madurez del niño o la niña

Minors, based on their immaturity, have limited legal capacity and their ability to act. In the same way, in the field of criminal law, their ability to take responsibility for the crimes committed is also limited. However, this does not prevent the legislator from establishing, when deemed appropriate, a different age limit for the exercise of certain rights and obligations based on their age and degree of maturity. Although the ownership of rights is recognized for all persons under 18 years of age (legal capacity), the effective exercise of these rights depends on the degree of development and maturity of the children.
