La Carta Social Europea constituye una referencia axiológica internacional de primer nivel, desde que se aprobara en 1961 y, ahora, en versión revisada, de la mano del Consejo de Europa. Sin embargo, su eficacia jurídica dista mucho de parecerse a la que tiene el Convenio Europeo de Derechos Humanos, firmado en la misma organización. La Carta está dirigida a los legisladores nacionales y carece de mecanismos jurídicamente coercitivos para forzar su correcta proyección sobre los ordenamientos estatales. A pesar de ello, se han hecho análisis sobredimensionados de este texto internacional, cuyo valor político es innegable, pero que tiene muchas limitaciones en cuanto a la garantía de su cumplimiento. En particular, no puede aceptarse que los órganos judiciales españoles consideren posible inaplicar, o complementar, la norma estatal dispuesta por el legislador, pretendiendo aplicar de forma directa la Carta Social Europea. El denominado "control de convencionalidad" tiene un recorrido bastante reducido, como acaba de remarcar el Tribunal Supremo en dos sentencias recientes.
The European Social Charter has been a major international axiological reference since its adoption in 1961 and now, in a revised version, by the Council of Europe. However, its legal effectiveness is far from resembling that of the European Convention on Human Rights, signed within the same organization. The Charter is addressed to national legislators and lacks legally coercitive mechanisms to force its correct projection on state legislations. Despite this, this international text, whose political value is undeniable, but which has many limitations in terms of guaranteeing its compliance, has been overanalyzed. In particular, it cannot be accepted that the Spanish judicial bodies consider it possible to inapply, or complement, the state norma provided by the legislator, pretending to apply directly the European Social Charter. The so-called "control of conventionality" has a rather limited scope, as the Supreme Court has just pointed out in two recent rulings.
