    La Sentencia del Tribunal de Justicia de la Unión Europea, de 30 de septiembre de 2021 (asunto C-296/20: Commerzbank c. AG) declara que el art. 15, ap. 1, letra c), del Convenio Lugano II, debe interpretarse en el sentido de que esta disposición determina la competencia en el supuesto de que el profesional y el consumidor, partes en un contrato de consumo, estuvieran domiciliados, en la fecha de la celebración de ese contrato, en el mismo Estado vinculado por dicho Convenio y de que un elemento de extranjería de la relación jurídica no surgiera hasta después de la referida celebración, debido al traslado ulterior del domicilio del consumidor a otro Estado vinculado por el mencionado Convenio.

    The judgment of the Court of Justice UE, of 30 September 2021 (Case C-296/20 Commerzbank v AG) declares that Article 15(1) (c) of the Lugano II Convention is to be interpreted as meaning that that provision determines jurisdiction where the trader and the consumer, who are parties to a consumer contract, are both domiciled in the same place. 1(c) of the Lugano II Convention must be interpreted as meaning that that provision determines jurisdiction where the trader and the consumer, parties to a consumer contract, were, at the time of the conclusion of that contract, both domiciled in the same State bound by that convention and where an element of foreignness in the legal relationship arose only after the conclusion of that contract because of the subsequent transfer of the consumer’s domicile to another State bound by that convention.
