In this article, the author revisits the work by armindo Monteiro entitled ‘introduction to the study of tax law’ that was published in 1949 and 1950. some of the more relevant aspects to the author's thoughts are highlighted: the criticism not only to fiscal neutrality but also to the sub- sequent fiscal revolution with its exaggerated increase in taxes and direct fiscal intervention;
the need for state subordination to law; tax law as a branch of fiscal law and, simulta- neously, the dogmatic autonomization of the former; refusal of a concept based on the authority of the tax justification; an apology of popular and individual consent;
and the defense of the principle ‘no taxation without representation’
Neste artigo, revisitamos o trabalho de armindo Monteiro, intitulado “introdução ao estudo do direito Fiscal”, publicado em 1949 e 1950. destacamos alguns aspetos mais relevantes do pensamento do autor: crítica às finanças neutras e também à revolução financeira com um aumento exagerado de impostos e intervenção financeira dirigista; necessidade de subordinação do poder público ao direito;
enquadramento formal do direito Fiscal no direito Financeiro, mas autonomização dog- mática deste último; afastamento da conceção autoritária da causa do imposto e a apologia do consentimento popular e individual; defesa da reserva de lei parlamentar
