Resumen de El Congreso Nacional y la interpretación constitucional en el proceso legislativo: criterios y momentos

  El Congreso Nacional es una de las cabezas fundamentales del poder legislativo.En ejercicio de sus funciones aplica e interpreta la Constitución. Por razones que se expli-carán en este trabajo, ese rol del Congreso Nacional en tanto intérprete de la Constituciónaparece tratado por la doctrina solo secundariamente, prestando mucha más atención al rolde los tribunales. Este trabajo quiere comenzar a completar ese vacío. Para ello, ofrece loscriterios que deberían guiar la indagación de la labor interpretativa constitucional del Con-greso Nacional durante el proceso legislativo, identificando los momentos de ese proceso quesatisfacen esos criterios. Ello debiera comenzar a pavimentar el camino para reivindicar ladignidad de la ley en tanto lectura de la Constitución, de cara a la más extensa literatura quese centra en tribunales, sentencias y jurisprudencia.

  The National Congress is one of the fundamental heads of the legislative branch. In the exercise of its functions, it applies and interprets the Constitution. For reasons that will be explained in this paper, its role as interpreter of the Constitution is treated by the doctrine only secondarily as compared to the attention the judicial interpretation receives. This paper aims to start filling this gap. To do so, it offers the criteria that should guide the investigation of the constitutional interpretative work of the National Congress during the legislative pro-cess, identifying the moments of that process that meet those criteria. This should begin to pave the way to vindicate the dignity of legislation as a reading of the Constitution, in the face of the more extensive literature that focuses on courts, rulings and case law.
