En un contexto de inseguridad jurídica y fruto de las presiones ejercidas por los propios investigadores predoctorales en formación se ha aprobado el Estatuto del personal investigador predoctoral en formación (EPIPF), con el que se cumple, aunque sea con un retraso totalmente inaceptable, con el mandato contenido en la disposición adicional segunda de la Ley de fa Ciencia A pesar de la entrada en vigor de dicha norma, el régimen jurídico de este colectivo de investigadores sigue planteando importantes cuestiones conflictivas que han tenido que ser resueltas por los tribunales. Ello es así porque, de un modo sorprendente, el EPIPF no ha abordado numerosas cuestiones litigiosas ya preexistentes a su entrada en vigor y que, por Io tanto, deberían haber sido resueltas por dicha norma, y porque, lo que todavía es más sorprendente, la entrada en vigor de la misma ha provocado nuevas cuestiones litigiosas inexistentes con anterioridad. En este estudio se pretenden exponer, precisamente, algunas de estas viejas y nuevas cuestiones litigiosas que plantea el régimen jurídico del EPIPF
In a context of legal uncertainty and as a result of the pressure exerted by the pre-doctoral researchers in training, the Statute of the pre-doctoral research staff in training has been approved, with which it complies, even with a totally unacceptable delay with the mandate contained in the second additional provision of the Law of Science. Despite the entry into force of this rule, the legal regime of this group of researchers continues to raise important conflictive issues that have had to be resolved by the courts. This is so because, surprisingly, the EPIPF has not addressed numerous litigious issues that already existed before its entry into force and that, therefore, should have been resolved by said rule, and because, what is even more surprising, the entry into force ot the same has led to new litigious issues that did not exist previously. This study seeks to expose, precisely, some of these old and new litigious issues raised by the legal regime of the EPIPF.
