    Este comentario tiene por objeto analizar el Auto de la Audiencia Provincial de Alicante, en virtud del cual se desestimó el recurso de apelación presentado por la demandada contra el Auto de instancia que declaraba el exequátur de una sentencia ecuatoriana de divorcio. La causa alegada por la recurrente y, desestimada por la Audiencia Provincial, fue la falta de firmeza de la sentencia de origen. La firmeza de una sentencia extranjera, presupuesto para su reconocimiento, debe ser acreditada por las partes con arreglo a lo establecido en el Derecho del Estado de origen.

    The purpose of this commentary is to analyze the Order of the Provincial Court of Alicante, by virtue of which the appeal filed by the defendant against the lower court’s Order declaring the exequatur of an Ecuadorian divorce judgment was dismissed.The ground relied on by the appellant and rejected by the Provincial Court was the lack of firmness of the original judgment. The firmness of a foreign judgment, which is a prerequirement for its recognition, must be established by the parties in accordance with the provisions of the law of the State of origin.
