Resumen de Derecho a la prestación por desempleo, compatibilidad entre indemnización y determinación de la baja de un trabajador suspendido de empleo y sueldo: comentario a tres importantes sentencias del Tribunal Supremo

  La variedad de temas que fueron analizados de mano del ex-magistrado del Tribunal Supremo, don Aurelio Desdentado Bonete, dan muestra del domino y conocimientos que el mismo tenía en materia de Seguridad Social. Muestra de ello son las tres sentencias que aquí se analizan. En la primera, se analiza si la suspensión de empleo y sueldo de un trabajador puede o no causar la baja del trabajador en la Seguridad Social. En segundo lugar, estudiaremos si es posible que una misma trabajadora cause derecho a dos indemnizaciones distintas: la primera por extinción improcedente de su contrato de trabajo y, la segunda, la prevista en convenio colectivo para la situación de incapacidad permanente total derivada de accidente de trabajo. Finalmente, comentaremos si tiene o no derecho a la prestación por desempleo la trabajadora que prestó servicios para una sociedad anónima.

  The variety of topics that were analysed by the former Supreme Court magistrate, Mr Aurelio Desdentado Bonete, show the dominance and knowledge that he had in the field of Social Security. The three rulings that are analysed here are proof of this. In the first, it is analysed whether the suspension of employment and salary of a worker may or may not cause the worker to leave the Social Security. Secondly, we will study whether it is possible for the same worker to be entitled to two different compensation: the first for unfair termination of their employment contract and, the second, the one provided for in the collective agreement for the situation of total permanent disability derived from an accident of job. Finally, we will comment on whether or not a worker who provided services for a public limited company is entitled to unemployment benefit.
