Resumen de La atribución voluntaria de ganancialidad: Reflejo de la autonomía privada en el régimen económico matrimonial. A propósito del artículo 1355 del Código civil

Con este trabajo se quiere enfatizar el papel que juega el principio de la autonomía de la voluntad, el poder de autodeterminación de los cónyuges, en el régimen económico matrimonial de la sociedad de gananciales, significativamente a través del supuesto tipificado por el artículo 1355 del Código civil; pero también por medio del negocio jurídico atípico conocido como negocio de aportación o comunicación a la sociedad de gananciales. El estudio se sustenta en las contribuciones al respecto, doctrinales y, en especial, en la jurisprudencia de la Sala Primera del Tribunal Supremo y en la doctrina de la Dirección General de Seguridad Jurídica y Fe Pública.

This paper want to emphasize the role played by the principle of autonomy of the will, the power of self-determination of the spouses, in the matrimonial property regime of the «sociedad de gananciales», significantly through the assumption typified by article 1355 of the Civil Code; but also through the atypical legal act known as the «negocio de aportación a gananciales». The paper is based on the contributions in this regard, by the authors and, especially, on the jurisprudence of the First Chamber of the Supreme Court and on the doctrine of the General Directorate of Legal Security and Public Faith.
