Resumen de La legitimación activa “popular” y la tutela efectiva en la acción de inconstitucionalidad en Ecuador

El artículo analiza la legitimación activa y la tutela judicial efectiva de la acción pública de inconstitucionalidad en Ecuador. El estudio demostró que la ciudadanía y los colectivos no tenían posibilidades reales para que sus demandas de inconstitucionalidad sean aceptadas por la Corte Constitucional.
A partir de los métodos cuantitativos y cualitativos, se examinaron las demandas presentadas y las sentencias expedidas entre 2008 y 2018;
información que permitió revisar los desarrollos jurisprudenciales de acción popular concebida como amplia y sin restricciones. Al contrastar los datos con los contenidos de la jurisprudencia, los resultados fueron incompatibles, los ciudadanos no lograron efectivizar el control constitucional en favor de sus derechos a pesar de que las sentencias hacen alusión a lo popular de la acción. De otro lado, se verificó que las acciones presentadas por las empresas y el Estado sí fueron efectivas, resultando favorables a sus intereses económicos y potestades públicas.

The article analyzes the active legitimacy and effective judicial protection of the public action of unconstitutionality in Ecuador. The study showed that citizens and collectives had no real possibilities for their unconstitutionality claims to be accepted by the Constitutional Court. Based on quantitative and qualitative methods, the claims filed and the judgments issued between 2008 and 2018 were examined; information which allowed for the review of jurisprudential developments of popular action conceived as broad and without restrictions. When comparing the data with the contents of the jurisprudence, the results were incompatible, citizens were not able to effectuate the constitutional control in favour of their rights despite the fact that the sentences allude to the popular nature of the action. On the other hand, it was verified that the actions presented by companies and the State were effective, being favorable to their economic interests and public powers.
