    El crédito revolving plantea una problemática procesal propia derivada de sus particularidades. Cuando el consumidor formule demanda solicitando que se declare la nulidad de uno de estos contratos, podrá invocar dos fundamentaciones jurídicas distintas: la Ley de la Usura y la Ley sobre Condiciones Generales de la Contratación. La primera se centra esencialmente en el elevado tipo de interés, atendiendo a los criterios que ha sentado la STS de 4 de marzo de 2020, mientras que la segunda ley realiza los controles de incorporación y de transparencia. Pese a tener orígenes y naturaleza muy diferentes, debe concluirse la compatibilidad de acumular, de modo eventual, ambas acciones. La Orden Ministerial 699/2020, de 24 de julio, facilitará en estos litigios la determinación del importe a reclamar al prestamista, bien inicialmente en la demanda o en un momento posterior.

    The revolving credit proposes its own procedural problems derived from its particularities. When the consumer makes a claim requesting that the nullity of one of these contracts be declared, he may invoke two different legal grounds: the Law of Usury and the Law of General Contracting Conditions. The first is essentially focused on the high interest rate in accordance with the criteria established by the Supreme Court Judgment of March 4, 2020, while the second law carries out the incorporation and transparency controls. Despite having very different origins and nature, the compatibility of accumulating, eventually, both actions must be concluded. Ministerial Order 699/2020, of July 24, will facilitate in these disputes the determination of the amount to be claimed from the lender, either initially in the claim or later.
