RESUMEN:
Los denominados “matrimonios por conveniencia” son un instrumento al servicio de unos fines distintos a los característicos e inherentes a la institución matrimonial. En este tipo de matrimonios se persiguen ciertos efectos secundarios, accesorios o indirectos del matrimonio, prescindiendo del efecto central o esencial del mismo, que no es otro que la convivencia matrimonial. Existe por tanto una contradicción entre la voluntad real, encubierta y la voluntad aparentemente manifestada; y, así, lo manifiestan las Sentencias de la Audiencia Provincial de Madrid, de 2 de octubre de 2020; de Cádiz, de 23 de noviembre de 2020 y la de Barcelona, de 27 de noviembre de 2020.

The so-called “marriages of convenience” are an instrument at the service of purposes other than those characteristic and inherent to the institution of marriage. In this type of marriages, certain secondary, accessory or indirect effects of the marriage are pursued, regardless of the central or essential effect of the same, which is none other than the marital coexistence. Therefore, there is a contradiction between the real, covert will and the apparently manifested will and, thus, it is manifested by the Sentences of the Provincial Court of Madrid, of October 2, 2020; of Cádiz, of November 23, 2020 and that of Barcelona, of November 27, 2020.
