En el presente trabajo indagaremos si es o no efectivo que las convenciones probatorias en el proceso penal chileno no solo eximen de prueba al dato de hecho sobre el que recaen, sino que las mismas pueden acordarse con prescindencia de las exigencias que el derecho a la presunción de inocencia impone a la auténtica prueba procesal de cargo.
In the present work we will investigate whether or not it is effective that the evidentiary conventions in the Chilean criminal process not only exempt from proof the factual data on which they fall, but that they can be agreed with no requirement of the requirements that the right to presumption of innocence imposes the evidence of guilt.
