Resumen de Las nuevas titulizaciones.: El Fondo Sabadell Consumo 1, FT

  En 201 7 se aprobó el nuevo Reglamento de Titulización, que pretende recuperar estos mercados en el seno de la Unión Europea, pero no fue hasta 2019 cuando el mismo entró en vigor, habiéndose demorado (incluso a la fecha del presente artículo) la publicación de muchas normas técnicas hasta bien entrado el año presente 2020. La operación de Sabadell Consumo 1, FT es la primera operación pública de titulización en España que se formaliza con todos los estándares y requerimientos de la nueva normativa. Su diseño planteó una serie de problemáticas jurídicas cuya resolución, creemos, fijará el estándar para muchas futuras titulizaciones españolas en el futuro.

  In 2017 the new Securitisation Regulation was approved which pretend to recover these markets within the European Union, but came into force in 2019, with big delays (to the date of this article) with respect the publication of technical rules even until this year 2020. Sabadell Consumo 1, FT, was the first public securitisation in Spain that implement the new requirements and standards of the new regulation. Its design creates some legal problems which resolution we think will set the standard for most of the future Spanish securitisations.
