Notificaciones y requerimientos que deban practicarse en el extranjero

    Se ponen de manifiesto ciertas incompatibilidades entre las notificaciones o traslados por correo cuya posibilidad está admitida en el Reglamento CE 1393/2007 y la normativa notarial española que excluye esa posibilidad para las actas de notificación y requerimiento propiamente dichas, circunscribiéndola a las simples actas de envío de documento por correo o medio similar, de muy distintos efectos.

    Se propugna el establecimiento a través de la Unión Internacional del Notariado de mecanismos y protocolos que, con suficiente amparo normativo, regulen las notificaciones y requerimientos por medios telemáticos no sólo de notario a notario, sino también de notario a destinatario.

    This article highlights certain incompatibilities between the use of postal services concerning documents, as stated in Regulation (EC) 1393/2007, and Spanish Law concerning the activities of notaries public, which excludes this possibility in the case of notices and summons, accepting the use of postal services or other similar means just when when simple deeds, with very different effects, are at stake. The author supports the creation of an International Union of Notaries, able to create new mechanisms and protocols that, under the adequate legislation, may regulate notices and summons sent by electronic means among notaries public and from the notary to the addressee.
